Copyright & Anti-Infringement Policy

1. Ownership Verification & Content Submission Standards

Every artist who submits content to BloomRecordz must affirm, at the time of upload, that:

  • They are the sole author, composer, and rights-holder of the submitted work, or have obtained all necessary licences, assignments, and written permissions from every rights-holder (master recording, underlying composition, samples, and any third-party contributions).
  • The content does not infringe any copyright, trademark, right of publicity, or other intellectual-property right of any third party.
  • No unlicensed samples, loops, beats, or interpolations are contained in the recording.
  • They have the legal authority to license the content to BloomRecordz and, through us, to digital service providers (DSPs) worldwide.

Submissions that do not meet these standards are rejected during our content-review process before any distribution takes place.

2. Content Review & Quality Control Process

All submissions go through a multi-stage review before they reach any streaming platform:

Stage 1 — Automated Scan

Audio fingerprinting and metadata checks run immediately on upload to flag potential matches against known copyrighted recordings.

Stage 2 — Human Review

Our moderation team manually reviews flagged submissions and verifies metadata accuracy, ISRC codes, and rights documentation within 24 hours.

Stage 3 — Approval & Distribution

Only content that passes both stages is approved and sent to DSPs. Rejected content is held and the submitting artist is notified with a reason.

BloomRecordz maintains a complete audit log of all submissions, reviews, approvals, and rejections to support any enforcement action or DSP inquiry.

3. Metadata Accuracy & Standards Compliance

Accurate metadata is essential for correct rights attribution. BloomRecordz enforces the following standards on every release:

  • ISRC codes — auto-generated to ISO 3901 standard for every track; artists may supply existing codes which are validated before use.
  • UPC/EAN barcodes — auto-generated to GS1 standard for every release.
  • Artist & label credits — must match the legal name of the rights-holder on file.
  • Composer / publisher data — required for any release involving a composition not wholly owned by the submitter.
  • Genre classification — selected from a controlled vocabulary to ensure correct DSP categorisation.
  • Release dates — validated against submission date to prevent fraudulent backdating.

Metadata is transmitted to DSPs in compliance with the DDEX (Digital Data Exchange) standard to ensure industry-wide interoperability and accurate rights management.

4. DMCA Takedown Procedure

BloomRecordz complies fully with the Digital Millennium Copyright Act (DMCA) and equivalent legislation in all territories we operate in. If you believe content distributed through our platform infringes your copyright, please submit a written notice containing all of the following:

  1. Your full legal name, address, telephone number, and email address.
  2. A description of the copyrighted work you claim has been infringed.
  3. A description of the infringing material and its location on our platform or the relevant DSP (e.g. Spotify link, ISRC, or BloomRecordz track ID).
  4. A statement that you have a good-faith belief that use of the material is not authorised by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on the owner's behalf.
  6. Your physical or electronic signature.

Upon receipt of a valid DMCA notice, we will:

  • Acknowledge receipt within 24 hours.
  • Remove or disable access to the alleged infringing content within 48 hours of verification.
  • Notify the submitting artist and provide them the opportunity to submit a counter-notice.
  • Escalate to relevant DSPs for takedown from their catalogues if the content has already been distributed.

5. Repeat Infringer Policy

BloomRecordz operates a strict repeat-infringer policy in accordance with DMCA requirements and DSP partner standards:

  • First violation — the infringing release is removed and the artist receives a formal written warning. All future submissions from that account are subject to enhanced review.
  • Second violation — the artist's account is suspended pending investigation. All active releases may be taken down from DSPs.
  • Third violation (or severe first violation) — the account is permanently terminated, all releases are taken down from all DSPs, and any outstanding royalties are withheld pending resolution.

Accounts that submit fraudulent content (e.g. content not owned by the submitter, content designed to game streaming counts, or content containing unlicensed recordings of third parties) are subject to immediate permanent termination without prior warning.

6. Streaming Fraud & Artificial Inflation Prevention

BloomRecordz has zero tolerance for streaming fraud. The following activities are strictly prohibited and will result in immediate account termination and reporting to affected DSPs:

  • Using bots, scripts, or third-party services to artificially inflate stream counts.
  • Incentivising or paying individuals to stream content to generate fraudulent royalties.
  • Submitting content to streaming platforms with the intent to collect royalties on recordings not owned or licensed by the submitter.
  • Creating multiple accounts to circumvent suspension or take advantage of promotional offers.

We cooperate fully with DSPs in fraud investigations and share data with Spotify, Apple Music, and other partners as permitted by our agreements and applicable law.

7. Counter-Notice Procedure

If you believe your content was removed by mistake or misidentification, you may submit a counter-notice containing:

  1. Your full legal name, address, telephone number, and email address.
  2. Identification of the removed content and its location before removal.
  3. A statement under penalty of perjury that you have a good-faith belief that the content was removed as a result of mistake or misidentification.
  4. Your consent to the jurisdiction of the Federal District Court for your district (or, if outside the US, any judicial district in which BloomRecordz may be found).
  5. Your physical or electronic signature.

Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, we may restore the content at our discretion.
